Objectives: The mental health legislation of most developed countries includes either a dangerousness criterion or an obligatory dangerousness criterion (ODC). A dangerousness criterion holds that mentally ill people may be given treatment without consent if they are deemed to be a risk to themselves or others. An ODC holds that mentally ill people may be given treatment without consent only if they are deemed to be a risk to themselves or others. This paper argues that the dangerousness criterion is unnecessary, (...) unethical and, in the case of the ODC, potentially harmful to mentally ill people and to the rest of the community. Methods: We examine the history of the dangerousness criterion, and provide reasoned argument and empirical evidence in support of our position. Results: Dangerousness criteria are not required to balance the perceived loss of autonomy arising from mental health legislation. Dangerousness criteria unfairly discriminate against the mentally ill, as they represent an unreasonable barrier to treatment without consent, and they spread the burden of risk that any mentally ill person might become violent across large numbers of mentally ill people who will never become violent. Mental health legislation that includes an ODC is associated with a longer duration of untreated psychosis, and probably contributes to a poorer prognosis and an increase risk of suicide and violence in patients in their first episode of psychosis. Conclusions: Dangerousness criteria should be removed from mental health legislation and be replaced by criteria that focus on a patient’s capacity to refuse treatment. (shrink)

Forty‐nine subjects judged the relevancy of sentence parts of a word problem (the Allsports problem). Patterns of subjects' judgments suggest three problem‐solving heuristics: a SETS heuristic, a TIME heuristic, and a QUESTION heuristic. Presentation of the question before the problem tends to suppress SETS and TIME heuristics. A computer program (ATTEND) is presented to simulate subjects' behavior on the Allsports problem. The program is context‐sensitive in that it can change a relevance judgment upon the acquisition of further information. Live donor kidney transplantation is the best treatment option for most patients with late-stage chronic kidney disease; however, the rate of living kidney donation has declined in the United States. A consensus conference was held June 5-6, 2014 to identify best practices and knowledge gaps pertaining to live donor kidney transplantation and living kidney donation. Transplant professionals, patients, and other key stakeholders discussed processes for educating transplant candidates and potential living donors about living kidney donation; efficiencies in the living donor (...) evaluation process; disparities in living donation; and financial and systemic barriers to living donation. We summarize the consensus recommendations for best practices in these educational and clinical domains, future research priorities, and possible public policy initiatives to remove barriers to living kidney donation. Context The attitudes of medical professionals towards physician assisted dying have been widely discussed. Less explored is the level of agreement among physicians on the possibility of ‘rational suicide’—a considered suicide act made by a sound mind and a precondition of assisted dying legislation. Objective To assess attitudes towards rational suicide in a representative sample of senior doctors in England and Wales. Methods A postal survey was conducted of 1000 consultants and general practitioners randomly selected from a commercially available database. (...) The main outcome of interest was level of agreement with a statement about rational suicide. Results The corrected participation rate was 50%; 363 questionnaires were analysed. Overall 72% of doctors agreed with the possibility of rational suicide, 17% disagreed, and 11% were neutral. Doctors who identified themselves as being more religious were more likely to disagree. Some doctors who disagreed with legalisation of physician assisted suicide nevertheless agreed with the concept of rational suicide. Conclusions Most senior doctors in England and Wales feel that rational suicide is possible. There was no association with specialty. Strong religious belief was associated with disagreement, although levels of agreement were still high in people reporting the strongest religious belief. Most doctors who were opposed to physician assisted suicide believed that rational suicide was possible, suggesting that some medical opposition is best explained by other factors such as concerns of assessment and protection of vulnerable patients. ObjectiveMost young adults diagnosed with breast or gynecologic cancers experience adverse reproductive or sexual health outcomes due to cancer and its treatment. However, evidence-based interventions that specifically address the RSH concerns of young adult and/or LGBTQ+ survivor couples are lacking. Our goal is to develop a feasible and acceptable couple-based intervention to reduce reproductive and sexual distress experience by young adult breast and gynecologic cancer survivor couples with diverse backgrounds.MethodsWe systematically adapted an empirically supported, theoretically grounded couple-based intervention to address (...) the RSH concerns of young couples coping with breast or gynecologic cancer through integration of stakeholder perspectives. We interviewed 11 couples with a history of breast or gynecologic cancer to review and pretest intervention materials. Three of these couples were invited to review and comment on intervention modifications. Content experts in RSH and dyadic coping, clinicians, and community advisors participated throughout the adaptation process.ResultsFindings confirmed the need for an online, couple-based intervention to support young couples experiencing RSH concerns after breast or gynecologic cancer. Qualitative themes suggested intervention preferences for: A highly flexible intervention that can be tailored to couples’ specific RSH concerns; Active steps to help members of a dyad “get on the same page” in their relationship and family building plans; A specific focus on raising partners’ awareness about how cancer can affect body image and physical intimacy; and Accessible, evidence-based information about RSH for both partners. These results, along with feedback from stakeholders, informed adaptation and finalization of the intervention content and format. The resulting virtual intervention, Opening the Conversation, includes five weekly sessions offering training to couples in communication and dyadic coping skills for addressing RSH concerns.ConclusionThe systematic adaptation process yielded a theory-informed intervention for young adult couples facing breast and gynecological cancers, which will be evaluated in a randomized controlled trial. The long-term goal is to implement and disseminate Opening the Conversation broadly to reach young adult couples with diverse backgrounds who are experiencing RSH concerns in cancer survivorship. Summary This paper seeks to be a systematic reflection on the difficulties raised by the sixteenth century Reformed notion of the atonement, rather than a repetitio of centuries-old methods of conceptualization. I will therefore look beyond the somewhat imprecise confessions of the period, and instead focus on the dogmatic work of John Calvin to find a more robust Reformed notion of the atonement. Yet, as we shall see, Calvin’s account of the atonement is not without its inconsistencies. Namely, if it (...) is the wrath of God that is satisfied on the cross of Christ, as Calvin states, then the divine love becomes obscured from view. In reply, Karl Barth’s theology of the atonement will be surveyed in order to uphold that the holy love of God is effective at every moment in the accomplishment of our redemption. Thus, this paper seeks to found a theology of the atonement guided by the Reformed theology of the sixteenth century, yet at the same time considers it possible to decisively bend the Reformed tradition without breaking with it. This is an excellent addition to Bobbs-Merrill's "Text and Commentary Series." In addition to the text of the Principles, there are eleven critical essays, three of which are original with this volume. Turbayne has arranged the essays to parallel the unfolding of the major themes in the Principles. Thus, he himself opens with "Berkeley's Metaphysical Grammar," which picks up and develops the theme of the centrality of the study of language to the philosophical enterprise, a point Berkeley makes in his (...) "Preface." Next, W. H. Hay and Richard Van Iten are paired together with different perspectives on Berkeley's nominalism. By way of comment on esse is percipi, G. E. Moore and W. T. Stace present their respective refutations of idealism and realism. Richard Popkin discusses skepticism and Berkeley. Popper examines the ways in which Berkeley anticipated Mach and Einstein, as well as significant features of contemporary philosophy of science. Turbayne and Cornman offer differing appraisals of the philosophy of mind that is sketched in the Principles. Paul Olscamp attempts to systematize the elements of Berkeley's critical theory. Finally, J. D. Mabbott treats of "The Place of God in Berkeley's Philosophy" and argues for a radical voluntarism in Berkeley--a not surprising analysis, but one which often gets buried under the epistemological issues raised in the Principles. Turbayne has also supplied an excellent introduction, a chronology of Berkeley's life, a working bibliography, and an analytical index. This enhances the usefulness of an already first-rate book.--E. Academic dishonesty, including cheating and plagiarism, is on the rise in colleges, particularly among engineering students. While students decide to engage in these behaviors for many different reasons, academic integrity training can help improve their understanding of ethical decision making. The two studies outlined in this paper assess the effectiveness of an online module in increasing academic integrity among first semester engineering students. Study 1 tested the effectiveness of an academic honesty tutorial by using a between groups design with a (...) Time 1- and Time 2-test. An academic honesty quiz assessed participants’ knowledge at both time points. Study 2, which incorporated an improved version of the module and quiz, utilized a between groups design with three assessment time points. The additional Time 3-test allowed researchers to test for retention of information. Results were analyzed using ANCOVA and t tests. In Study 1, the experimental group exhibited significant improvement on the plagiarism items, but not the total score. However, at Time 2 there was no significant difference between groups after controlling for Time 1 scores. In Study 2, between- and within-group analyses suggest there was a significant improvement in total scores, but not plagiarism scores, after exposure to the tutorial. Overall, the academic integrity module impacted participants as evidenced by changes in total score and on specific plagiarism items. Although future implementation of the tutorial and quiz would benefit from modifications to reduce ceiling effects and improve assessment of knowledge, the results suggest such tutorial may be one valuable element in a systems approach to improving the academic integrity of engineering students. Cuando Searle propuso el experimento mental de La Pieza China hubo gran cantidad de objeciones. Aparentemente, muchas fueron contestadas convincentemente por él. Sin embargo, Dennett y Hofstadter plantearon una interesante crítica en 1981, una que no solo era aplicable a este experimento mental, sino a muchos otros posteriores en filosofía de la mente. En particular, apuntaron a la dudosa confiabilidad de los escenarios que favorecen intuiciones sobre la propia mente de un experimentador. Así, propusieron una nueva categoría: las “bombas de (...) intuiciones”. Curiosamente, Dennett también ha elaborado algunas bombas de intuiciones, y ello ha ocurrido pese a que no hay total claridad de cuándo es correcta la aplicación del término. En este trabajo argumento que la dificultad para caracterizar tanto dichas bombas como su utilidad no solo se explica por la naturaleza problemática de la mente, sino además por el dogmatismo que implican tanto el enfoque materialista como el dualista. Las normas del Derecho Internacional Humanitario establecen límites al uso de los medios y métodos de combate en el desarrollo de las hostilidades. Si bien en su origen el DIH no fue elaborado teniendo en cuenta los desafíos planteados por el desarrollo de la inteligencia artificial en ese contexto, es una realidad que en la actualidad la evolución de esta inteligencia, los algoritmos y su aplicación militar emergente constituyen un desafío a la luz de las normas humanitarias. Ese desafío comprende (...) tres ámbitos fundamentales: el técnico, el legal y el ético. Si bien se puede decir que la IA, en la etapa actual de desarrollo, permite que un programa computerizado basado en algoritmos realice ciertas tareas en un entorno complejo e incierto, a menudo con mayor precisión que los seres humanos, también debemos destacar que no hay tecnología que haga que una máquina se comporte como un ser humano, quien puede determinar si una acción es lícita o ilícita y decidir no continuar con lo programado, teniendo como objetivo primordial la protección de las víctimas. Los Estados deben adoptar regímenes de verificación, prueba y monitoreo como parte del proceso para determinar e imponer limitaciones o prohibiciones de acuerdo a los principios esenciales de distinción y proporcionalidad que el DIH establece en la utilización de armas durante los conflictos armados internacionales o no internacionales. Tanto desde una perspectiva legal como ética el ser humano está en el centro de esta problemática, ya que la responsabilidad por el uso de la fuerza no puede transferirse a sistemas de armas o algoritmos, y sigue siendo una responsabilidad humana. Mind uploading speculation and debate often concludes that a procedure described as gradual in-place replacement preserves personal identity while a procedure described as destructive scan-and-copy produces some other identity in the target substrate such that personal identity is lost along with the biological brain. This paper demonstrates a chain of reasoning that establishes metaphysical equivalence between these two methods in terms of preserving personal identity.

Con el objeto de dar cuenta de la dinámica del derecho, Alchourrón y Bulygin distinguen los conceptos de sistema jurídico y de orden jurídico. El primero hace referencia a un conjunto de enunciados que contiene todas sus consecuencias deductivas, entre las cuales hay normas cuyo contenido son actos coactivos. Se trata de una entidad estática. El orden jurídico, por su parte, es concebido como una secuencia de sistemas jurídicos enlazados por algún criterio de legalidad o validez, y conserva su identidad (...) a través de los cambios producidos por la sanción o derogación de normas. Es mi propósito presentar argumentos tendientes a sostener que la noción de orden jurídico no es adecuada para los fines que se propone y, además, su postulación, con el sentido que le atribuyen los autores, resulta innecesaria. Aiming to account for the dynamic nature of law, the Argentinian philosophers Carlos Alchourrón and Eugenio Bulygin discriminate the concepts of legal system and legal order. The first makes reference to a set of statements that includes all their deductive consequences, among which there are norms that prescribe coercive acts. It is a static entity. legal order, on the other hand, is conceived as a sequence of legal systems connected by some criterion of legal validity and keeps its identity through the changes produced by the passing or abrogation of laws. The aim of this paper is to present arguments leading to support that the notion of legal order is inadequate for its declared purpose and, furthermore, its conception, with the meaning the authors assign to it, is unnecessary. We can gain fresh insights into aspects of criminal liability by focusing first on the prior topic of criminal responsibility, and on the relational dimensions of responsibility: responsibility is responsibility for something, to someone. We are criminally responsible as citizens, to our fellow citizens, for committing 'public' wrongs: I discuss the difficulty of giving determinate content to this idea of public wrongs, and the way in which, whereas moral responsibility is typically strict, criminal responsibility is not. Finally, I explore the (...) grounds on which defendants might deny that they are criminally responsible before the courts that seek to try them. (shrink)

Se pretende resaltar aquí la veta kantiana que atraviesa el pensamiento de Javier Muguerza. Este hilo conductor se pondría de manifiesto sin ir más lejos en las tres «Críticas» muguerzianas, a saber: Crítica de la razón analítica, Crítica de la razón dialógica y Crítica de la razón onírica. Pero también cabe detectarlo en el denominado «imperativo de la disidencia», con que Muguerza quiere actualizar las tres versiones del imperativo categórico kantiano y que le hace apostar, finalmente, por un blochiano primado (...) de la utopía. En definitiva, todo ello acaba por invitarnos a replantear las célebres preguntas kantianas. Desde luego, a Javier Muguerza le interesan mucho más las cuestiones dejadas abiertas por Kant que sus respuestas, y hay que agradecerle que sepa traducirlas a las inquietudes filosóficas del presente. Si no estoy equivocado, nuestro acervo cultural nos hace asociar casi automáticamente a la culpa con un concepto religioso, de raigambre judeocristiana para ser más precisos, mientras que al mismo tiempo tiende a identificar la responsabilidad con una categoría eminentemente jurídica. La culpa se presenta como algo estrechamente vinculado con el pecado y la religión o, a lo sumo, con el psicoanálisis, en tanto que la responsabilidad suele circunscribirse de oficio al ámbito del derecho penal o relacionarse protocolariamente con la (...) esfera política. Sin embargo, aunque las palabras «culpa» y «responsabilidad» no se prodiguen demasiado en los diccionarios consagrados a la ética, sí constituyen conceptos claves de la reflexión moral. Mi propósito aquí es presentarlos como dimensiones o vertientes complementarias de nuestra conciencia. Desde luego, cualquiera puede asumir una determinada responsabilidad sin sentirse culpable y, a la inversa, siempre hay quien prefiere regodearse con su sentimiento de culpabilidad sin sentirse responsable por la causa del mismo, pero lo suyo es que ambas nociones vayan de consuno y la culpa sea un síntoma de responsabilidad o que atender a las propias responsabilidades ahuyente cualquier asomo de culpabilidad por nuestra parte.
